If a payer submitted a late box 7 1099-MISC forms along with other non-box 7 1099-Misc forms not containing nonemployee payments to IRS, the IRS might treat all submitted 1099-Misc forms as late information returns.

The IRS has had to analyze the 1099-MISC forms obtained to determine the correct deadline and apply late filing penalties and fines appropriately. The IRS replaced Form 1099-NEC instead of form 1099-Misc to reduce these problems.
